Modifying child support in Michigan

Child support orders are put in place to ensure the proper financial care of a child. However, some life events may warrant a child support modification.

To properly claim a modification, it is important for parents to understand the various elements of the process. There are a few key factors to know in regards to modifications of child support in Michigan.

Grounds

For the courts to award a modification, the parent filing, also known as the moving party, must show a substantial change of circumstances. Some examples of this include:

  • Child's needs or care expenses increase
  • Loss of a job
  • Receiving a raise or new job
  • Change in custody arrangement

These are a few of the most common grounds for a modification. A knowledgeable attorney may be helpful in establishing the best argument for a modification.

Process

A parent must file a court motion to request a hearing for the modification. Within the hearing request, the moving party must detail the reason for the requested change and the new desired support amount. The courts utilize the child support payment calculator to determine the difference, review any provided evidence to determine if the change is necessary and make a decision.

Child's interest

At the end of the day, the interest of the child is the main concern of the court, and should be for the parents as well. Whether a parent seeks additional support or needs to decrease the current amount of support provided, it may be beneficial to try to work it out with the other parent first. To make it official, it must still go before the judge, but the courts favor parents working together and will likely uphold the requested modifications. This can help to decrease court time and strain on the relationship between parents, which may also benefit the child.

As you can see, the modification process is straightforward but can become time-consuming. Make sure you fully understand the process so you may make the best decision for you and your child.
