Yes, a prenuptial agreement may be right for you

Your wedding day is closing in fast, and you soon realize that you need to discuss the creation of a prenuptial agreement with your partner. While it's not the easiest conversation to have, getting your feelings out in the open will allow you to feel better about the future.

Here are some of the many reasons why a prenuptial agreement may be right for you (and your partner):

  • To document your individual property: If you and/or your partner are bringing separate property into the marriage, such as a house, car or inheritance, you can use a prenuptial agreement to ensure that it remains this way in the future. That way, in the event of a divorce, it's not subject to property division.
  • To protect the inheritance rights of other children: If you have children from a previous relationship, you may want to use a prenuptial agreement to protect their inheritance rights, as things are sure to change once you tie the knot.
  • To assign debt to each individual: Just the same as assets, you and/or your partner may be bringing debt into the marriage. From credit cards to student loans to back taxes, there are many types of debt. Adding these to your prenuptial agreement will ensure that you're not on the hook for paying these debts should you divorce.

For many couples, the most difficult part of creating a prenuptial agreement is bringing their feelings to light. Once you do this, you'll feel better about your ability to create an agreement that suits both of you now and protects both of you in the event of a future divorce.
