What to do if your spouse doesn’t want to divorce

You've thought about it long and hard, and you've come to the conclusion that you want to divorce your spouse. It's an important decision, as it'll affect you and your family both now and in the future.

Asking your spouse for a divorce is difficult enough. But if they fight you on it, saying that they want to work things out, it can cause even more frustration and anger.

Here's what you can do if your spouse doesn't want to divorce:

  • Explain your position: In an honest and courteous manner, explain why you want a divorce. For example, you could tell your spouse that you've already tried counseling and things aren't getting better.
  • Hear them out: Even though you have no intentions of changing your mind, you should give your spouse the opportunity to speak their mind. Don't talk during this time. Listen to every word they say so you can begin to formulate a response.
  • Stand your ground: It's hard to do, but if you know that divorce is what you want, you shouldn't turn back now. You've shared your feelings, and now it's time to move on with the divorce process.

If you decide to ask your spouse for a divorce, go into the conversation with the idea that they may fight you to give your marriage another chance.

If you're sure that you don't want to change your mind, explain this to your spouse as nicely as possible while respecting their position. Once you're finally on the same page, you can file the necessary documents to start the divorce process.
